A Charitable Trust is a legal entity created for charitable purposes including education, healthcare, poverty relief, environmental protection, and social welfare. Any group of individuals (minimum 2 trustees) who wish to engage in charitable activities can form a charitable trust. The trust must have clearly defined charitable objectives in the Trust Deed.

A Trust can be created for any lawful purpose including religious, family, or commercial purposes. A Charitable Trust is specifically created for charitable purposes as defined under the Income Tax Act. All charitable trusts are trusts, but all trusts are not charitable trusts. Charitable trusts are eligible for tax exemptions under 12A and 80G.

A charitable trust can engage in business activities as long as the primary purpose remains charitable and the profits are used for charitable objectives. However, if the business becomes the main activity, the trust may lose its charitable status. It is advisable to keep business activities incidental to the main charitable purpose.

After obtaining 12A registration, the income of the charitable trust is exempt from income tax. With 80G registration, donors can claim a deduction of 50% of their donation from taxable income.
