ITR-U (Previous Year / Missed ITR)

The three routes compared
- Revised (139(5)): correct errors in a filed return - free of extra tax, usable till 31 Mar 2027 this cycle
- Belated (139(4)): file when you missed the due date - 234F fee + interest, due 31 Dec 2026
- Updated (139(8A)): disclose extra income found later - extra tax 25%/50%, usable within 24 months of the AY end
- Do not mix: revise only an already-filed return; file belated if nothing was filed; update for later discoveries
Fees and costs
- 234F on belated/revised: Rs. 5,000 (nil for income up to Rs. 5 lakh)
- Interest 234A/234B/234C as applicable on any delay
- Updated return: 25% additional tax if filed by 31 March 2028; 50% if within 31 March 2029 (for AY 2026-27)
- 173/271D consequences only in egregious non-disclosure cases - disclosure is always cheaper than notice
Decision rules
- Found an error in a filed return? - file revised immediately
- Never filed and the date passed? - file belated before 31 Dec 2026
- Money came to light later (e.g., a delayed FD interest credit)? - updated return with extra tax
- Losses and refunds: belated returns lose only carry-forward benefits in some cases (check 139(4) loss provisions)
- Updated returns cannot be used for loss claims or reducing tax
What you should do
- Act today if a filing is still pending - every month adds interest
- After the due date, file the return even if fee applies - it beats a notice (121(1) resilience)
- Cross-check AIS after filing and use a revised return for anything material
- Keep the proof of your original filing date - it matters for 139(5) timing
